ORDER 09.03.2026 Heard Mr. S Banik, learned counsel for the applicant. Also heard Mr. T Gogoi,
learned counsel for the respondents No. 1 to 6.
2. The writ petitioner/applicant has approached this Court by filing W.P(C) No. 749/2026 claiming the amounts lying in the Bank account as the legal heirs of her late husband. The claim of pensionary benefits in respect of the late husband of the writ petitioner was initially released only in favour of respondent No. 7 who also claims to be a wife of Late Bijit Das.
3. The learned counsel submits that since the amount has been lying in the bank account belonging to the late husband and the bank authorities has not disbursed the amount or has informed the petitioner as to the manner on how they would resort to disbursement of the amount. He submits that effective
Page No.# 5/5 direction to be issued by the court to resolve the matter between the writ petitioners No 1 & 2 and the respondent No. 7 in respect of the amount lying in the account of late Bijit Das.
4. Since the address of the respondent No. 7 was not known to the petitioner in the cause title in W.P(C) No. 749/2026, the address was shown as the C/O Branch Manager, Punjab National Bank, AT Road Branch, AT Road, Guwahati. While the Court had issued notice on 11.02.2026, the learned counsel representing the Bank had already furnished the address particulars of respondent No. 7.
5. The present interlocutory application has been filed seeking liberty to incorporate the correct address as furnished by the Bank authorities in so far as the respondent No. 7 is concerned. The particulars of her address is specified in paragraph 6 in the interlocutory application. The learned counsel for the applicant therefore submits that he be permitted to file amended cause title incorporating the correct addresses.
6. In view of the submissions made and in view of the fact that no objections have been raised by the learned counsel for the respondents, the interlocutory application stands allowed.
7. The applicant is permitted to file amended cause title in respect of respondent No. 7 to be incorporated by way of an amended cause title in W.P(C) No. 749/2026.
8. The interlocutory application accordingly stands allowed and disposed of. JUDGE Comparing Assistant
