Accused in Crime No.428 of 2025 registered by Govindarajanagara Police Station, Bengaluru City for the offence punishable under Section 103(1) of BNS, 2023 is before this Court in this petition filed under Section 483 of BNSS, 2023. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.428 of 2025 was registered by Govindarajanagar Police Station, Bengaluru City for the aforesaid offence against petitioner herein, based on the first information dated 01.11.2025 received from Sri Giriprasad Chennur, who was working along with the deceased and the petitioner herein in a private company. During the course of investigation of the case, petitioner was arrested on 01.11.2025 and remanded to judicial custody. After completing investigation, charge sheet has been filed against him for the aforesaid offence. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.2649 of 2026 was rejected on 02.04.2026. Perusal of the material on record would go to show that, deceased Bhimesh Babu was working as a Manager in a private company, where the petitioner and the first informant were also working as digital managing technicians in the said company. Deceased Bhimesh babu used to scold petitioner for small mistakes in the office. On the intervening night of 31.10.2025 and 01.11.2025 at about 01.30 a.m, the petitioner allegedly came to the room of first informant in the motorbike of the deceased and informed the first informant that he had assaulted Bhimesh Babu with a dumbbell, after he had abused him referring to his parents in a filthy language. Immediately, thereafter the first informant and the petitioner went to the place where petitioner had assaulted Bhimesh Babu and they shifted Bhimesh Babu to a hospital in an ambulance. The doctor who examined Bhimesh Babu allegedly informed the first informant that Bhimesh Babu had died. It is in this background, FIR was registered against the petitioner for the aforesaid offence. 5. Undisputedly, petitioner has no criminal antecedents. The alleged incident has taken place in the midnight of 31.10.2025 and 01.11.2025 after deceased had - 4 - HC-KAR NC: 2026:KHC:29290 CRL.P No. 5827 of 2026 abused the petitioner using filthy language against his parents. It appears that in a fit of rage, petitioner had assaulted deceased Bhimesh Babu with dumbbell, which was lying nearby and as a result, Bhimesh Babu had suffered injuries. Immediately thereafter, petitioner had gone to the house of first informant and had informed him about the incident and thereafter came back to the place of incident and made efforts to shift injured Bhimesh Babu to a hospital. This conduct of the petitioner gives scope for a doubt as to whether he had any intention to commit the murder of the deceased. 6. Investigation of the case is now completed and charge sheet has been filed. Trial in the case is yet to commence. Allegations found in the charge sheet are required to be proved in a full-fledged trial. Under the circumstances, I am of the opinion that the prayer made by the petitioner, aged 24 years having no criminal antecedent, for grant of regular bail needs to be answered affirmatively. 7. Accordingly, the following: ORDER Criminal petition is allowed. - 5 - HC-KAR NC: 2026:KHC:29290 CRL.P No. 5827 of 2026 The petitioner is directed to be enlarged on bail in Crime No.428 of 2025 registered by Govindarajanagara Police Station, Bengaluru City for the offence punishable under Section 103(1) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future. e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
