The complainant has filed the present complaint alleging willful disobedience of the order dated 24.02.2025 passed by the learned Single Judge of this Court in WP.No.2572/2024 (BDA). 2. In terms of the said order, the BDA was directed to consider the complainant's case after affording him an opportunity of a personal hearing and bearing in mind the report/order of Justice Sri. D.V. Shylendra Kumar Committee. The accused has issued an endorsement dated 07.11.2025. However, it is alleged that the accused was not afforded any opportunity to be heard. - 3 - HC-KAR NC: 2026:KHC:9700-DB CCC No. 1228 of 2025 3. The learned counsel for the accused submits that the sale deed had already been executed prior to the filing of the writ petition and therefore nothing further could be done without the complainant taking further steps. 4. It was necessary for the BDA to have brought this fact to the notice of the learned Single Judge in WP.No.2572/2024. However, the same was not done. It does appear that the order dated 24.02.2025 was passed on an assumption that BDA had yet to execute the sale deed. 5. In view of the above, we do not consider it apposite to initiate any proceedings for the willful disobedience of the order under Contempt of Court Act, 1971.
