The Court made the following ORDER:
Heard the learned counsel for the petitioner and the learned Assistant Government Pleader appearing for the respondent Nos.1 to 4. 2. The issuance of notice to the respondent Nos.5 and 6 is dispensed with as no prejudice would cause to them even if it is disposed of in their absence. 3. This Writ Petition is filed questioning the order of the 3rd respondent dated 20.04.2026, resuming the subject land to the Government as per Section 4(1)(a) of the Andhra Pradesh Assigned Land (Prohibition of Transfers) Act, 1977. 4. The learned counsel for the petitioner submits that the petitioner is the legal heir of the original assignee and they are in possession and enjoyment of the subject land. Having held that the irregular entries made in favour of the unofficial respondents herein to be deleted from 1B Khata No.1504 of Pyadindi Village of Chennekothapalli Mandal, the 3rd respondent ought to have restored the land to the petitioner, instead, the impugned resumption order was passed dated 20.04.2026. 5. On the other hand, the learned Assistant Government Pleader appearing for the respondent Nos.1 to 4, submits that further appeal lies before the Joint Collector, Sri Sathya Sai District within 90 days from the date of receipt of the said order. 6. In reply, the learned counsel for the petitioner submits that the appeal time of 90 days is there to assail the same before the Joint Collector, Sri Sathya Sai District. 7.
In view of the above said facts and circumstances, the petitioner is permitted to prefer an appeal before the Joint Collector, Sri Sathya Sai District, within the limitation period, by enclosing all the necessary documents in support of his claim, assailing the order of the 3rd respondent dated
20.04.2026. On receipt of such appeal from the petitioner, the Joint Collector, Sri Sathya Sai District, shall consider and dispose of the same, strictly in accordance with law, by hearing all the parties concerned, including the petitioner and the unofficial respondents herein, upon verification of the records and the subject land, appropriate decision shall be taken on its own merits, as expeditiously as possible, preferably, within a period of four (04) months thereafter. Pending the appeal, there shall be an order of status-quo as on today to be maintained with respect to the subject land covered under the impugned order of the 3rd respondent dated 20.04.2026. In default of preferring the above said appeal by the petitioner, the interim protection granted by this Court stands automatically vacated. 8. Accordingly, the Writ Petition is disposed of.
