Learned counsel for the Petitioner submits that the Petitioner- husband has preferred an appeal under Section 29 of the Protection of Women from Domestic Violence Act, 2005 against the order dated 03.01.2026 passed by the learned Judicial Magistrate First Class in Miscellaneous Criminal Case No.09/2021. It is submitted that the said appeal is presently pending before the appellate Court and the respondent-wife has ARPAN SRIVASTAVA Digitally signed by ARPAN SRIVASTAVA Date: 2026.06.18 17:38:03 +0530
2 already entered appearance therein. He further submits that the Petitioner is suffering from serious visual disability and one of his eyes has completely lost vision and the vision in the other eye is impaired to the extent of about 80%. Considering his physical condition and the nature of the controversy involved, it is prayed that appropriate directions be issued for expeditious disposal of the pending appeal.

Upon perusal of the material available on record, this Court is of the opinion that the ends of justice would be served by directing the Appellate Court to dispose of the said appeal expeditiously. Accordingly, without expressing any opinion on the merits of the controversy involved in the appeal, the learned Sessions Judge, Balod/Appellate Court is directed to make all endeavour to hear and finally decide Criminal Appeal No.17/2026, as expeditiously as possible, preferably on or before 31st July, 2026, in accordance with law.
3. With the aforesaid observation and direction, the present Criminal Miscellaneous Petition stands disposed of. Sd/-
