INDIRESH ORAL ORDER In this petition, the petitioner is challenging the order dated 04th February, 205 (Annexure-K) passed by the respondent No.2-Deputy Commissioner in R.P. No.43/2025; inter alia sought for allowing the Revision Petition by setting aside the Endorsement dated 02nd January, 2025 (Annexure-J) issued by the respondent No.3-Assistant Commissioner. 2. Heard Sri. Srinivas V., learned counsel appearing for the petitioner; Sri. B.J. Eswarappa, learned Additional Government Advocate appearing for respondents 1 to 4; and Sri. K.R. Nagaraja, learned counsel appearing for respondents 5 to 10. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned order dated 04th February, 2025 (Annexure-K) passed by the respondent No.2 in R.P. No.43/2025, the same would indicate - 4 - HC-KAR NC: 2026:KHC:27725 WP NO.16067 OF 2025 that, notice has not been issued to the respondents in the Revision petition before the respondent No.2-Deputy Commissioner and also records have not been called for from the respondent No.3-Assistant Commissioner. In that view of the matter, I find force in the submission made by learned counsel appearing for the petitioner that the impugned order passed by the respondent No.2-Deputy Commissioner in Revision Petition is required to be quashed and matter be remitted back to the respondent No.2 for fresh consideration. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 04th February, 2025 (Annexure-K) passed by the respondent No.2-Deputy Commissioner in R.P. No.43/2025 is hereby set-aside; and matter is remitted back to the respondent No.2 with a direction to reconsider the issue afresh and pass appropriate orders in accordance with law, after affording an opportunity of hearing to all the parties and by considering the original records secured from the respondent No.3; - 5 - HC-KAR NC: 2026:KHC:27725 WP NO.16067 OF 2025 (iii) Since the parties are representing through their respective counsels, in order to avoid further delay in the matter, parties are directed to appear before the respondent No.2-Deputy Commissioner on 13th July, 2026 at 03.00 p.m.; (iv) The respondent No.2-Deputy Commissioner is directed to complete the proceedings within an period of six months from the date of appearance of the parties.
