1. The Circle Officer, Hehal to remain present at 2:15 P.M. before this Court along with the original records of Mutation Case No. 3248 of 2013-14, today itself. 2:15 P.M.
2. Mr. Ghanshyam Kumar the Circle Officer, Hehal is present through V.C., and there is no complaint regarding clarity of audio and video. 3. During course of arguments, Mr. Ashutosh Anand, the learned Additional Advocate General, who is assisting this Court on behalf of the State submits that the original file in respect of the mutation application filed by one Amit Gupta which was directed to be disposed of by virtue of the final order passed in W.P(C) No. 4095 of 2019 is not traceable, though in the filing register it has been mentioned that the said application has been disposed of. ( 2026:JHHC:21752 )
4. He submits that he is also not in a position to submit the copy of the final order passed in the mutation case, so that the petitioner can take the appropriate legal steps. 5. Considering the peculiar situation Mr. Ashutosh Anand the learned Additional Advocate General suggested that if the petitioner files a fresh application for mutation along with all necessary documents, irrespective of the fact that his earlier petition got dismissed, the Circle Officer Hehal will consider the case for mutation of the petitioner independently, and will pass an appropriate order and the earlier order of dismissal will not be considered and will not become a bar in filing fresh application. 6.
Considering the same and to resolve the issue, I direct the petitioner to file a fresh application before the Circle Officer, Hehal with all the documents who will consider the same and will pass an appropriate order after giving one opportunity of hearing to the petitioner and will communicate the order to the petitioner. 7. It is expected that the petitioner will file an application within 4 weeks, and the Circle Officer, Hehal will dispose of the same within 12 weeks thereafter, and will communicate the order to the petitioner. 8. Accordingly, this writ application stands disposed of. 9. Pending IA(s), if any, also stand disposed of. 10. It is made clear that the earlier dismissal of the mutation application will not come in the way of the petitioner in filing a fresh application, nor it will come in the way of the authorities in deciding the fresh application of the petitioner. 11. The matter is to be decided on its own merits, without being prejudiced by the earlier order. (ANANDA SEN, J.)
