KAMAL - 3 - HC-KAR NC: 2026:KHC:28919 WP No. 15857 of 2023 ORAL ORDER On 09.02.2026, this court passed the following order; "The petitioner, who is a practicing advocate, having been issued with an order of punishment in the nature of removal of his name in the State Roll of Advocates and debarring him from practicing in any court or before any authority or person in India, permanently, in terms of Section 35(3)(d) of the Advocates' Act, 1961, is before this Court. 2. The daily orders sheet indicate that on 26.07.2023, this Court had shown indulgence, subject to a voluntary undertaking given by the petitioner of he paying a sum of Rs.15,00,000/- to respondent No.3, within eight (8) weeks thereon, the order impugned was stayed till the next date of hearing. The said interim order has been periodically extended. 3. In the meanwhile, petitioner is also stated to have paid an aggregate sum of Rs.6,00,000/- as against payment of Rs.15,00,000/- as agreed, and has remained due to pay the balance sum of Rs.9,00,000/-. 4. Earlier, the petitioner was being represented by his counsel, who is stated to have withdrawn his vakalat. Therefore, this Court by order dated 16.10.2025 had directed the Office to reflect the name of the petitioner in the cause-list. 5. An application I.A.No.1/2024 is filed by the respondent seeking to initiate contempt proceedings against the petitioner for non-compliance of the order/undertaking noted above. 6. It is submitted that by virtue of the interim order, though conditional, the petitioner is continuing to practice before the trial Courts as well as before this Court. 7. Learned counsel for respondent Nos.2 and 3 has furnished the mobile number of the petitioner, which is "94483 83783". An attempt is made by this Court to contact the petitioner over the said number to intimate the posting of the matter and there is no response. 8. List this matter on 15.06.2026 for further orders. 9. In order to expedite, learned counsel appearing for respondent Nos.2 and 3 is directed to communicate the next date of hearing to the petitioner as '15.06.2026'." - 4 - HC-KAR NC: 2026:KHC:28919 WP No. 15857 of 2023 2. Pursuant to aforesaid order learned counsel for respondent no.2 and 3 has filed an affidavit along with the letter dated 10.06.2026 with the postal receipts and postal track. 3. The affidavit of the counsel on record indicates that he had contacted the petitioner on his mobile numbers 7259691105 as well as 998383783 and he had also communicated through a letter dated 10.06.2026 sent through registered post with acknowledgement due, intimating the date of hearing. 4. Yet there is no representation on behalf of the petitioner. 5. In the circumstance petition stands dismissed for non- prosecution. The order of dismissal of this petition shall be communicated to the Bar Council for necessary entries in the registry. - 5 - HC-KAR NC: 2026:KHC:28919 WP No. 15857 of 2023 The respondent no.2 and 3 are at liberty to initiate such proceedings against the petitioner as may be permissible under the law.
