THIS PETITION, COMING ON FOR ORDER, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.T. NARENDRA PRASAD - 3 - HC-KAR NC: 2026:KHC:15647 WP No. 7955 of 2026 ORAL ORDER 1. In this writ petition, the petitioner has sought for the following relief/s: “a) Issue writ of mandamus directing the Trial court to dispose of the suit in O.S.No.556/2018 on pending of learned Senior Civil Judge and J.M.F.C., Hosakote as per Annexure-D, within a reasonable time to avoid unreasonable adjournments; b) To grant such other reliefs as this Hon’ble Court may deems fit under the facts and circumstances of the case in the interest of justice.” 2. The learned counsel for the petitioner–plaintiff submits that the petitioner–plaintiff has filed a suit for specific performance of contract before the Principal Senior Civil Judge, Bengaluru Rural District, Bengaluru (hereinafter referred to as ‘Trial Court’ for short) in O.S.No.556/2018 (thereafter re-numbered as O.S.No.1019/2022). Upon service of summons, the defendants appeared through counsel and filed their - 4 - HC-KAR NC: 2026:KHC:15647 WP No. 7955 of 2026 written statements. Based on the pleadings of the parties, issues were framed on 07.09.2020. Even after a lapse of more than five years, the evidence has not been concluded. The defendants, for one reason or another, are dragging the matter by seeking adjournments. Hence, the learned counsel seeks a direction to the Trial Court to dispose of the suit in O.S.No.1019/2022 as expeditiously as possible. 3. In view of the above, without expressing any opinion on the merits of the case, the writ petition is disposed of. 4. The Trial Court is directed to dispose of the suit in O.S.No.1019/2022, as expeditiously as possible, and in any event not later than one year from the date of receipt of the certified copy of this order, provided there is no order of stay of the said proceedings by any Court of law.
