Petitioner versus 1. Mrs. Kiran Kaushal Managing Director, Chhattisgarh State Market Federation Maryadit, Atal Nagar, Naya Raipur, Distt. Raipur (C.G.) 2. Shri Rajendra Dhruv District Marketing Officer, Department Of Food, Civil Supplies And Consumer Protection, Jagdalpur, District- Bastar (C.G.) 3. Shri Harish S Collector (Food Department), Jagdalpur, District- Bastar (C.G.) ... Respondent(s) For Petitioner : Mr. Akhtar Hussain, Advocate holding the brief of Mr. Ramsajiwan, Advocate For Respondents No. 1 & 2 : Mr. Animesh Tiwari, Advocate Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 18.06 .2026 1. The petitioner has filed this contempt petition alleging disobedience of order dated 29.04.2025 passed in WPC No. 2112 of 2025. 2. The facts in brief are that the petitioner/partner and director of rice mill purchased 81,452 quintals of paddy from Nagrik Apurti Nigam and he was supposed to return 55,118.6 quintals of Custom Milled Rice (CMR) to Marketing Federation(Mark. Fed.). The petitioner deposited CMR with the Mark. Fed., but when 2177.91 quintals of rice was left with the petitioner as SIDDHANT TAMRAKAR Digitally signed by SIDDHANT TAMRAKAR Date: 2026.06.18 17:33:27 +0530 2 the Mark. Fed. declined to accept it, therefore, WPC No. 2112 of 2025 was filed and vide order dated 29.04.2025 direction was issued to the Mark. Fed. to permit the petitioner to deposit 2177.91 quintals of Custom Milled Rice (CMR) by 30.04.2025 subject to verification of quantity and quality. 3. Pursuant to said order the Mark. Fed. permitted the petitioner to deposit 267 quintal of CMR, thereafter, the respondents No. 1 & 2 preferred a review petition, which was disposed of vide order dated 31.01.2026, whereby, correspondence dated 26.03.2025 was made part of the order passed in writ petition. 4. Correspondence dated 26.03.2025 reads as under :- "1/ छत्तीसगढ़ राज्य सहकारा विपणन सघ मय. 5. It appears that the respondents No. 1 & 2 after physical verification found shortage of 2455.52 quintals of CMR, and therefore, they did not accept the Custom Milled Rice pursuant to order passed in WPC No. 2112 of 2025, but prior to passing of order in review petition, the petitioner succeeded to deposit 267 quintals of CMR with the Mark. Fed. 6. As the correspondence dated 26.03.2025 has already been made part of order passed in WPC No. 2112 of 2025, therefore, the respondents were not in position to overlook or ignore said document. They physically verified the 3 stock and found shortage of 2455.52 quintals of Custom Milled Rice, even though they permitted the petitioner to deposit 267 quintals of CMR. It appears that there is no disobedience of order passed in WPC No. 2112 of 2025. 7. Accordingly, contempt proceeding is dropped. Notice issued to respondents stand discharged.
