JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioners – accused Nos.1 to 3 are before this Court calling in question proceedings in C.C.No.3933/2026, pending before the XLI Additional Chief Judicial Magistrate, Bengaluru - 3 - HC-KAR NC: 2026:KHC:27699 CRL.P No. 7736 of 2026 City, for the offences punishable under Sections 115(2), 126(2), 351(2), 352 and 79 r/w. 3(5) of the BNS, 2023. 2. Learned counsel for the petitioners and respondent No.2 would in unison submit that the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions. The parties have filed an application – I.A.No.1/2026 under Section 528 r/w. 359 of the BNSS, 2023, appending a joint memo before this Court seeking permission to compound the offences. 3. The joint memo reads as follows: “JOINT MEMO FOR COMPROMISE UNDER SECTION 528 R/W 359 OF THE BHARATIYA NAGARIK SURAKSHA SANHITHA, 2023: The Petitioners and the Victim in the above case most humbly file the following joint compromise memo for compounding the offences. 1. The Petitioners herein are facing trial in Crime No.184/2025 of Amruthahalli Police Station, which after investigation has culminated in C.C. No. 3933/2026, for the offences punishable under Sections 115(2), 126(2), 351(2), 352, 79 and read with Section 3(5) of the Bharatiya Nyaya Sanhita, 2023, as well as under Section 25(1)(A) of the Indian Arms Act, and the same is presently pending on the file of the Hon'ble 41" Additional Chief Judicial Magistrate, Bengaluru. - 4 - HC-KAR NC: 2026:KHC:27699 CRL.P No. 7736 of 2026 2. It is submitted that, due to the intervention of elders, well-wishers, and family members of both parties, the dispute between the Petitioners and the Complainant has been amicably settled; the parties have resolved their differences and have decided to live peacefully, and the Complainant has no objection for compounding/quashing of the case and does not wish to prosecute the present case any further. 3. The Petitioners and the Complainant respectfully submit that this Hon'ble Court may kindly read the averments made in the main petition as part and parcel of this affidavit, to avoid repetition. WHEREFORE, the Petitioners and the Complainant most humbly pray that this Hon'ble Court be pleased to accept this Joint Affidavit of Compromise and permit compounding/quash the proceedings in Crime No. 184/2025 culminating in C.C. No.3933/2026 pending on the file of the Hon’ble 41st Additional Chief Judicial Magistrate, Bengaluru, in the interest of justice and equity.” In the light of the afore-quoted joint memo of the parties, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals and not against the State. 4.
