Petitioners are before this Court seeking for the following reliefs: "WHEREFORE, the Petitioners most humbly pray that this Hon'ble Court may be pleased to: i. Pass an order in the nature of a writ of mandamus or any writ/order/direction directing the Respondent No. 2 to other - 3 - HC-KAR NC: 2026:KHC:28884 WP No. 14830 of 2024 respond appropriately and within a time-bound manner to the: (a) Offer made by the Petitioners in the minutes of the meeting held on 30.11.2023, produced as ANNEXURE-A, (b) Representations dated 05.01.2024 and 31.01.2024 as issued by the Petitioner, produced as ANNEXURE-B AND C, (c) Reminder-2 dated 05.01.20034 with Reference NHAI/PIU- RMNG/NH-275/13016/10/2023-34/1995 issued by Respondent No.1 to Respondent No.2. produced as ANNEXURE - D, and (d) Reminder letter dated 02.02.2024 with reference No. NHAI/PIU-RMNG/NH-275/Package-11/BL/2023-24/2177 was again addressed by Respondent No.1 to Respondent No.2, produced as ANNEXURE-E. ii. Pass such necessary order directing the Respondent No. 1 to black-list the Respondent No. 2 and restrain them from ever engaging their services; iii. Pass necessary orders towards cost of this petition; iv. Pass such other relief(s) and further reliefs as this Hon'ble Court deems fit and necessary considering the facts and circumstances of the present petition, in the ends of justice and equity. v. To direct The Respondents to consider Representation letter dated 07.03.20.24. (Annexure-Q)". 2. The petitioners grievance is that the offer made by the petitioners on 30.11.2023 at Annexure A, representations dated 04.01.2024, 31.01.2024 at Annexures - B and C, reminder -2 dated 05.01.2024 at Annexure - D, reminder no.3 dated 02.02.2024 at Annexure - E have not been considered by this - 4 - HC-KAR NC: 2026:KHC:28884 WP No. 14830 of 2024 respondent. Whenever any representation is submitted to an Authority, it is required to consider the same and pass necessary orders either accepting or rejecting the representation. 3. In the present matter, the first representation has been made on 05.01.2024. No orders have been passed by respondent no.1 till date. Allegations, if any, have been made against respondent no. 2, before passing any order respondent no.1 could always call upon respondent no.2 to offer any explanation that respondent no.2 may have as regards the allegations made against respondent. 4. In that view of the matter, I pass the following: ORDER (i) Writ petition is partly allowed. (ii) Respondents are directed to consider the representations of the petitioners dated 30.11.2023 at - 5 - HC-KAR NC: 2026:KHC:28884 WP No. 14830 of 2024 Annexure A, representations dated 04.01.2024, 31.01.2024 at Annexures - B and C, reminder -2 dated 05.01.2024 at Annexure D, reminder no.3 dated 02.02.2024 at Annexure - E (reminders by respondents) and pass necessary orders within a period of 30 days from the date of receipt of a copy of this order.
