Mr. Amitabh Pradhan, learned Additional Standing Counsel submits that one Bhagirathi Sahoo, who is father of suspect Nilu Sahu has stated that on 22.08.2023 evening his son Nilu Sahoo, Deepak Das, Kanha @ Rakesh Patra, Bijay Jena, Raghu Pradhan, Jayant Mohapatra, Gudu Mohapatra, Santu Behera and others were gambling near Godijhara pond. Since somebody shouted police police, all ran away from the spot. He subsequently learnt after two days that body of Deepak Das was floating in the ‘Chua’ near the temple. From this it is not apparent whether there was any eyewitness to the occurrence. That apart, perusal of the FIR and
statements of the Petitioner and her husband recorded under Section 161 of Cr.P.C. reveals that they learnt from reliable sources that the accused persons had murdered their son due to prior enmity but till date investigation does not reveal that what was the prior enmity.
2. The case has been registered on 14.09.2023 and pending since 2003. The viscera report which is annexed to the affidavit filed by Opposite Party No.3 does not reveal presence of any poison, alcohol or drugs in the stomach and intestine of the deceased. More than two and half years have elapsed and the IIC, Tangi is presently conducting investigation.
3. In view of the nature of the allegation and the slow pace of investigation, the Superintendent of Police, Khurda is directed to ensure that investigation in the case is supervised by the SDPO, Balugaon or any senior officer and that investigation is completed without further delay.
4. With this observation, the CRLMP is disposed of.
