Accused in Crime No.143/2025 registered by Bandepalya Police Station, Bangalore, for offence punishable under Section 69 of Bharatiya Nyaya Sanhita (BNS), 2023 (hereinafter referred to as 'BNS, 2023' for short) is before this Court in this criminal petition filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail. 2. Heard learned counsel appearing for the petitioner and learned Addl. SPP appearing for the respondent-State. 3. FIR in Crime No.143/2025 was registered by Bandepalya Police Station, Bangalore, for the aforesaid offence against the petitioner herein based on the first information dated 04.10.2025 received from the victim lady, aged about 38 years. In the said case, the petitioner was arrested on 27.11.2025 and remanded to judicial custody. Investigation was subsequently completed and - 3 - HC-KAR NC: 2026:KHC:29566 CRL.P No. 4034 of 2026 charge sheet was filed against the petitioner for the aforesaid offence. His bail application filed before the Trial Court in Criminal Misc.No.799/2026 was rejected on 19.02.2026. Therefore, the petitioner is before this Court. 4. Perusal of the material on record would go to show that the victim lady was earlier married and she has a son from the said wedlock. She has stated that she got acquainted with the petitioner in the month of April 2021 onwards and subsequently they started loving each other and were residing together. Allegation against the petitioner is that with a promise to marry the victim lady, he had sexual intercourse with her. In the month of July 2025, he had returned to his native place in Uttar Pradesh and got married to some other lady. It is under these circumstances, the victim lady approached the police on 04.10.2025. 5. From the aforesaid, it is very clear that the victim lady and the petitioner were in a consensual relationship - 4 - HC-KAR NC: 2026:KHC:29566 CRL.P No. 4034 of 2026 for more than 4 years. Only after the said relationship failed, the victim lady had approached the police. Investigation of the case is completed and charge has been filed. 6. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. Accordingly, the following order: ORDER The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.143/2025 registered by Bandepalya Police Station, Bangalore, for offence punishable under Section 69 of Bharatiya Nyaya Sanhita (BNS), 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; - 5 - HC-KAR NC: 2026:KHC:29566 CRL.P No. 4034 of 2026 b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
