with him. In 2014, disputes arose between the parties, leading to the initiation of civil and criminal proceedings against each other. Pursuant to a complaint lodged by Respondent No. 2 and directions issued by the learned ACMM, Saket Courts, New Delhi, FIR No. 12/2015 was registered at Police Station New Friends Colony for offences under Sections 419, 420, 467, 468, 471, 506 and 120-B of the IPC. The investigation was subsequently transferred to the Economic Offences Wing, New Delhi, and a charge-sheet was filed before the concerned Trial Court. 4. The parties subsequently amicably settled their disputes by way of a Settlement Deed dated 25.07.2016. Earlier petitions seeking quashing of the FIR were withdrawn with liberty to take appropriate steps in accordance with law. The petitioners have now approached this Court under Section 528 of the BNSS, seeking quashing of the aforesaid FIR, the consequential charge-sheet and all proceedings emanating therefrom, on the ground that the disputes have been amicably resolved and Respondent No. 2 has no surviving grievance against them.
The parties thereafter executed a Supplementary Deed of Settlement dated 01.10.2025, reaffirming their intention to resolve their disputes and seek quashing of the criminal proceedings arising out of the aforesaid FIR. 5. Respondent Nos. 2 and 3, who are present before this Court and have been duly identified by the Investigating Officer, state that they have amicably settled their disputes with the petitioners of their own free will, without any force, pressure, threat or coercion. They further state that they have no objection to the quashing of the FIR in question and the consequential proceedings. Insofar as Respondent No. 4 is concerned, her affidavit/no- objection certificate, duly executed and notarised in Singapore, is already on This is a digitally signed order. record, wherein she has expressed her no objection to the quashing of the FIR. 6. This Court has considered the facts and circumstances of the case and the settlement arrived at between the parties. The dispute arises out of financial and property-related transactions between private parties and is predominantly of a civil and personal nature. The parties have voluntarily resolved their differences, and the complainant and the other private respondents do not wish to pursue the criminal proceedings any further. Having regard to the nature of the allegations, the settlement arrived at between the parties and the material placed on record, this Court is of the view that the continuation of the criminal proceedings would serve no useful purpose and would amount to an unnecessary prolongation of the dispute. 7.
Accordingly, in order to secure the ends of justice and prevent abuse of the process of law, FIR No. 12/2015, registered at Police Station New Friends Colony, New Delhi, under Sections 419, 420, 467, 468, 471, 506 and 120-B of the IPC, along with the consequential charge-sheet and all proceedings emanating therefrom, is hereby quashed qua the petitioners. 8. The present petition stands disposed of in the aforesaid terms. Pending application(s), if any, also stand disposed of. 9. A copy of this order be communicated to the concerned Trial Court for information and necessary compliance. 10. The order be uploaded on the website forthwith.
