This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 658 of 2026 to its original file. Learned counsel for the petitioner submits that B.A. No. 658 of 2026 was rejected as not pressed. It is next submitted that due to inadvertence and mistake, the counsel for the petitioner could not mark the case in the cause list hence, he could not appear before this Court when the case was called out and the same resulted in dismissal of B.A. No. 658 of 2026. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 658 of 2026 and unless B.A. No. 658 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 658 of 2026 be restored to its original file. Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 658 of 2026 is restored to its original file to the stage at which it was, before its dismissal.
