Order No.03 Dated- 24.07.2026
Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioners for restoration of Criminal Appeal (S.J.) No. 1096 of 2025 to its original file.
Learned counsel for the petitioners submits that Criminal Appeal (S.J.) No. 1096 of 2025 was dismissed for non-compliance of the peremptory order of filing supplementary affidavit. It is next submitted that as there was delay in surrendering by the petitioners before the learned trial court, hence, the said supplementary affidavit could not be filed within the stipulated time and the same resulted in dismissal of Criminal Appeal (S.J.) No. 1096 of 2025. It is further submitted that non- compliance of the peremptory order was neither deliberate nor intentional. It is next submitted that the petitioners have very good grounds to agitate in the said Criminal Appeal (S.J.) No. 1096 of 2025 and unless Criminal Appeal (S.J.) No. 1096 of 2025 is restored to its original file, the petitioners will be highly prejudiced. Hence, it is
submitted that Criminal Appeal (S.J.) No. 1096 of 2025 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, Criminal Appeal (S.J.) No. 1096 of 2025 is restored to its original file to the stage at which, it was before its dismissal.
List Criminal Appeal (S.J.) No. 1096 of 2025 under the appropriate heading before the appropriate bench after a week.
