1. By way of this petition, the petitioner is challenging the proceedings of election case no. 202102061300037 pending before respondent No.2/Sub-Divisional Officer, Champa, whereby respondent No.2 entertained the application for recounting of ballot papers preferred by one of the contesting candidates without complying with the statutory mandate and settled principles governing election law in India.
2. Learned State Counsel submits that present petition has become infructuous as challenge raised herein pertains to recounting of the earlier election for the term 2020-2025, which tenure has already come to an end.
3. In view of above, the instant petition is dismissed as having become infructuous. CC as per rules.
