2 Crime No.600/2025 registered at Police Station – Tikrapara, Raipur, District- Raipur (C.G.), for the offences under Sections 21(c), 27, 27(a) and 29 of NDPS Act as also under Section 111 of BNS and 25 of Arms Act.

According to prosecution, on 03.08.2025, acting on secret information, the police of Police Station Tikrapara, Raipur, conducted a search at EWS Block-B, House No. 504, Sector- 4, Kamla Vihar, Raipur. During the search, 10.23 grams of heroin was allegedly recovered from the possession of co- accused Suvit Shrivastava and 402.64 grams of heroin from the possession of co-accused Lavjeet Singh, while a mobile phone was seized from co-accused Ashvin Chandravanshi. During investigation, the memorandum statements of the co- accused were recorded, wherein the name of the present Applicant surfaced. It is further alleged that, in his memorandum statement, the Applicant disclosed that an amount of Rs.10,000/- had been deposited in his bank account by co-accused Lavjeet Singh. Based on the aforesaid allegations, the police registered the offences as mentioned above against the present Applicant. Hence, this application.

Learned counsel for the Applicant submits that the Applicant is innocent and has been falsely implicated in the present
3 case. It is further submitted that no seizure has been effected from the possession of the present Applicant, who has been in judicial custody since 30.08.2025. He further submits that the only allegation against the present Applicant is that he has taken Rs.10,000/- from co-accused Lavjit Singh and the conclusion of trial is likely to take considerable time, therefore, it is prayed that he may be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the bail application and submits that the ofences registered against the present Applicant and the co-accused persons are under Sections 27A, 27 read with 21(c) and 29 of the NDPS Act and Section 111 of the BNS, for which the permissible period prescribed for completion of investigation and filing of the charge-sheet is 180 days, however, she fairly admits that no seizure has been effected from the possession of the present Applicant. She further submits that there are seven other co- accused persons whose bail applications have been rejected by this Court vide orders dated 23.02.2026, 27.02.2026, 23.03.2026 and 01.04.2026 passed in M.Cr.C Nos.10347/2025, 7965/2025, 2028/2026, 2678/2026, 2636/2026, 2899/2026 and 2901/2026 respectively and therefore, the bail application of the present Applicant also deserves to be rejected. 4

Having heard learned Counsel for the parties and considering the facts and circumstances of the case, particularly the nature and gravity of the offences alleged against the present Applicant under Sections 27A, 27 read with 21(c) and 29 of the NDPS Act and Section 111 of the BNS, this Court is not inclined to grant bail to the Applicant at this stage. Though no seizure has been effected from the possession of the present Applicant, the allegation against him is that he had received an amount of Rs.10,000/- from co-accused Lavjit Singh and the investigation has revealed his involvement in the alleged offence. It is also noteworthy that the bail applications of similarly placed co-accused persons have already been rejected by this Court vide orders dated 23.02.2026, 27.02.2026, 23.03.2026 and 01.04.2026 passed in M.Cr.C. Nos.10347/2025, 7965/2025, 2028/2026, 2678/2026, 2636/2026, 2899/2026 and 2901/2026 respectively.
Considering the bar contained under Section 37 of the NDPS Act and without expressing any opinion on the merits of the case, this Court does not find any ground to enlarge the Applicant on bail. Accordingly, the bail application deserves to be and is hereby rejected. 6. Accordingly, the bail application of the applicant – Charanjit Singh @ Chand involved in Crime No. 600/2025 registered
5 at Police Station – Tikrapara, Raipur, District- Raipur (C.G.), for the offences under Sections 21(c), 27, 27(a) and 29 of NDPS Act as also under Section 111 of BNS and 25 of Arms Act is hereby rejected. 7.
