Order No.03 Dated- 24.07.2026
Heard the parties.
This criminal miscellaneous petition has been filed at the instance of the petitioner for restoration of B.A. No. 3045 of 2026 to its original file.
Learned counsel for the petitioner submits that B.A. No. 3045 of 2026 was dismissed for non-compliance of the peremptory order of depositing Rs.1,000/- with JHALSA. It is next submitted that due to inadvertence, the counsel for the petitioner could not deposit Rs.1,000/- with JHALSA and the same resulted in dismissal of B.A. No. 3045 of 2026. It is further submitted that the petitioner has deposited Rs.1,000/- with JHALSA. It is then submitted that non- compliance of the peremptory order was neither deliberate nor intentional. It is next submitted that the petitioner has very good grounds to agitate in the said B.A. No. 3045 of 2026 and unless B.A. No. 3045 of 2026 is restored to its original file, the petitioner will be highly prejudiced. Hence, it is submitted that B.A. No. 3045 of 2026 be restored to its original file.
Considering the aforesaid submission of the learned counsel for the petitioner and the facts of this case, B.A. No. 3045 of 2026 is
restored to its original file to the stage at which, it was before its dismissal.
List B.A. No. 3045 of 2026 under the appropriate heading before the appropriate bench after a week.
