This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No. 0080/2026 registered at Police Station – Manipur, District – Surguja (C.G.) for the offences punishable under Sections 132, 221, 296, 351(3) and 3(5) of the Bhartiya Nyaya Sanhita, 2023. According to the prosecution's story, the complainant, namely Ravi Shankar Pal, who is the driver of a JCB vehicle, stated that on 02.05.2026, in compliance with the order dated 30.04.2026 passed by the Commissioner, Municipal Corporation, Ambikapur, land near the New Bus Stand, HDFC ATM, Ring Road, Ambikapur, was being levelled by filling a pond with soil. During the said work, soil was being excavated through a JCB machine and loaded into vehicles. It is alleged that during the course of the said work, the present applicants, along with the main accused, namely Azad Iraqi, arrived at the spot, obstructed the government work, abused the complainant in filthy language, threatened to kill him, and drove away the JCB and tractor from the site. Thereafter, the complainant lodged a report against the present applicants and the main accused at Police Station Manipur, Ambikapur. On the basis of the aforesaid allegations, FIR No. 0080/2026 was registered against the present applicants and other co-accused persons at Police Station Manipur, District Surguja (C.G.), for the offences punishable under Sections 132, 221, 296, 351(3), and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in this case. He submits that the other co-accused person, namely, Azad Iraqi has already been granted anticipatory bail by this Hon’ble Court in MCRCA No. 744 of 2026 vide order dated 13.05.2026. Therefore, he submits that the present applicants are also entitled to be released on anticipatory bail on the ground of parity. 4. On the other hand, learned State counsel, appearing for the non - applicant/State, opposes the bail application of the present applicants. 3 However, he could not dispute the fact that an identically situated co- accused has already been granted anticipatory bail by this Court. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case that in the present case, the co-accused persons, namely, Azad Iraqi has already been granted anticipatory bail by this Hon’ble Court in MCRCA No. 744 of 2026 vide order dated 13.05.2026, therefore, I am inclined to grant anticipatory bail to the present applicants on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Ashif Qurashi @ Pappu and Irshad Aalam on executing a personal bond and one surety each in the like sum to the satisfaction of the arresting Officer, she shall be released on bail on the following conditions:- (a) they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court. (b) they shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) they shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d) the applicants and the surety shall submit a copy of their adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
