The petitioner has filed the present writ petition calling in question the legality, validity and propriety of the order dated 04.06.2026 passed by respondent No.2, whereby the appeal preferred by the petitioner has been dismissed and the order dated 16.12.2024 passed by the Collector, District Durg has been affirmed. The petitioner has prayed for following relief(s):- “a. This Hon'ble Court may kindly be pleased to quash the impugned order, dt. 04/06/2026 [Annexure-P/1]. 3 b. This Hon'ble Court may kindly be pleased to issue a writ in the nature of mandamus or suitable direction to the respondents affirming the 1st appellate order, dt. 27/04/2023 Annexure P/4 passed by the S.D.O.[R], Durg with all consequential benefits etc. c. This Hon'ble Court may kindly be pleased to allow any other relief as the Hon'ble deemed fit and proper along with the cost of petition.” 2. Learned counsel for the petitioner submits that the petitioner had earlier challenged the order passed by the Collector, Durg by filing W.P.(C) No.888 of 2025. The said writ petition was disposed of by this Court vide order dated 23.09.2025 granting liberty to the petitioner to avail the statutory remedy of appeal before the Commissioner, Durg Division, Durg. Pursuant thereto, the petitioner preferred an appeal before the Commissioner, which has also come to be dismissed by the impugned order dated 04.06.2026. 3. At this stage, after arguing the matter for some time, learned counsel for the petitioner seeks permission to withdraw the present writ petition with liberty to avail the further statutory remedy of revision before the competent Board of Revenue. It is submitted that the petitioner would also prefer an appropriate application for interim protection before the revisional authority. 4 4. Learned State counsel has no objection to the prayer so made. 5. Considering the prayer made by learned counsel for the petitioner, the present writ petition is dismissed as withdrawn with liberty reserved in favour of the petitioner to file an appropriate revision before the competent Board of Revenue, if so advised and permissible under law. 6. In the event such revision along with an application for interim relief/stay is filed by the petitioner, the concerned Board of Revenue shall consider and decide the same expeditiously, in accordance with law, without being influenced by any observation made in the present order. 7. It is made clear that this Court has not expressed any opinion on the merits of the case and all questions are left open to be considered by the revisional authority. 8. With the aforesaid observations and liberty, the instant writ petition stands disposed of as withdrawn. 9. Certified copies of all documents/annexures filed along with the writ petition be returned to learned counsel for the petitioner after retaining photocopies thereof on record, in accordance with rules.
