Notice. Mr. Rajesh Kashyap, learned counsel, appears and waives service of notice on behalf of the respondents. With the consent of learned counsel for the parties, the matter is heard at this stage. 3. Petitioner is serving as Superintendent (Grade D/A) in Andhara Power House Division, Chirgaon. He feels aggrieved against the order dated 20.08.2026 that transfers

Learned Senior counsel for the petitioner submits that petitioner is aged more than 56 years and is due to superannuate on 31.01.2028 or in other words, he is left with less than two years to retire. It was also pointed out that no one else has been transferred to the place of the petitioner at Chirgaon. The petitioner is continuing to serve there. Clause 5.5 of the applicable transfer policy was pressed into service, in terms of which Class- III and Class- IV officials due to retire within two years, as far as possible, should be posted in convenient places/stations subject to vacancies. 4. Taking into consideration the factual position pertaining to petitioner's impending retirement, and the fact that no one else has been posted against the petitioner at his present place of posting, this writ petition is disposed of with liberty reserved to the petitioner to represent to respondent No. 1 within a week from today. In case such a representation is made, the same shall be considered and decided within two weeks thereafter, keeping in view the facts pointed out and the provisions of the applicable transfer policy. Till such time, the impugned office order
3 dated 20.08.2026 shall not be given effect to. It goes without saying that in case the petitioner does not avail the liberty granted to him under this order, the limited protection provided to him hereinabove shall cease to have effect. The decision so arrived at shall also be communicated to the petitioner.
