CORAM:
HON'BLE MR. JUSTICE JASMEET SINGH O R D E R % 05.10.2026 CM APPL. 69115/2026
1. This is an application filed under Section 151 of CPC, 1908, seeking correction of the date of birth of the petitioner. 2. For the reasons stated in the application, issue notice. 3. Mr. Kumar, learned counsel, accepts notice on behalf of the respondent No. 1
4. Since the relief sought in the application is the same relief sought by way of the present writ petition, the petition is taken up for hearing. W.P.(C) 9795/2024
5. The brief facts of the matter are that the petitioner was born on 11.09.1981 at Nasirpur, Post Palam, New Delhi, as the daughter of Shri Dharam Dev Solanki and Smt. Jagmati Devi. The petitioner’s Birth Certificate was issued by the South Delhi Municipal Corporation dated This is a digitally signed order. 13.01.2015 which mentions the Date of Birth of the petitioner as 11.09.1981. The passport, Aadhar Card as well as the Pan Card of the petitioner all mention the same Date of Birth, i.e. 11.09.1981. 6. In Class Xth marksheet of the petitioner, the Date of Birth of the petitioner was wrongly recorded as 03.09.1981 instead of 11.09.1981. Therefore, the petitioner had approached respondent No. 1 through a representation dated 11.11.2023 seeking correction of the same. 7. However, the respondent No. 1, vide letter dated 16.01.2024, informed the petitioner that the Date of Birth recorded in her school records is
03.09.1981. Subsequent thereto, on 29.01.2024, another representation was submitted by the petitioner to the respondent No. 1 seeking the said correction. The respondent No. 1 responded to the same, seeking submission of certain documents, which the petitioner accordingly submitted. The respondent No. 1 still did not make the correction in the Date of Birth as sought. 8. Hence, the present petition was filed. 9. Mr. Kumar, learned counsel for the respondent No. 1, relying on Jigya Yadav v. CBSE (2021) 7 SCC 535, opposes the present petition and states that the Date of Birth reflected in school records cannot be replaced with a new one in a casual manner. 10. I have heard learned counsel for the parties. 11.
I have already in similar matter of Nisha Ray v. Central Board Of Secondary Education & Anr. W.P.(C) 6554/2023, by relying on the
judgment of Hon’ble Supreme Court in the case of Jigya Yadav (supra), reiterated the holding of the Hon’ble Apex Court that there can only be one Date of Birth and reconciliation of such discrepancies to make it consistent This is a digitally signed order. with other documents will cause no prejudice to the respondent No. 1/CBSE. Hence, the same must be allowed. The petitioner having produced documents including her Birth Certificate, Aadhar Card, Pan Card and Passport, all depicting the same Date of Birth i.e. 11.09.198, it cannot be said that the aforesaid correction as sought by the petitioner is being allowed in a casual manner.
12. If the present petition is not allowed, the petitioner would be having two dates of births, one shown in public documents like the birth certificate and Aadhar Card, and the other reflected in these given Class Xth marksheet and the academic records.
13. Accordingly, the date of birth of the petitioner shall be read as 11.09.1981 and all documents/academic records of the petitioner shall be altered in accordance therewith.
14. The present petition stands disposed of in the aforesaid terms.
15. In view of the aforesaid, the next date of hearing fixed earlier, i.e., 27.11.2026 stands cancelled.
