The petitioner is before this Court seeking for the following reliefs: (a) Issue a writ of certiorari and quash the endorsement dated 12.09.2025 bearing No.H.N.P:C.R:38/2025-26 passed by the Respondent No.1 at Annexure-A; (b) Issue a writ of mandamus directing the Respondent No.1 to consider the application filed by the Petitioner as per law contemplated under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and pass necessary orders in accordance with law; (c) Pass any orders that, this Hon'ble Court deems fit in the interest of justice and equity. 2. The Petitioner is Senior Citizen had filed an application under Section 23 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 (hereinafter referred to as ‘the Act’ for short). Respondent No.1 issued an endorsement on 12.09.2025 calling upon the Petitioner to approach the Civil Court since there are disputed questions. Whenever any application is filed by a Senior Citizen or a parent under any of the provisions of the Act, it is required for the Authority to register the same and pass necessary orders after hearing the matter and not reject the same by issuing an endorsement. Endorsement being an administrative order and not a quasi-judicial order contemplated under the Act. The endorsement is not sustainable in law. As such, this Court passes the following: ORDER i) Writ petition is allowed. ii) The endorsement dated 12.09.2025 at Annexure-A is set aside. iii) Respondent No.1 is directed to consider the application filed by the Petitioner in accordance with law and pass necessary orders.
