The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, praying for following relief:- “i. Pass an Order quashing/setting aside Impugned ECIR No.RPZPO/09/2022 dated 06.10.2022 registered under Sections 3, 4 PMLA at P.S. ED-RPZO (ANNEXURE P-1), and all subsequent proceedings emanating therefrom including the prosecution complaint as well as their Cognizance order, qua the Petitioner herein; and/or ii. Pleased to quash the order dated 12.03.2026 passed by the learned Special Court PMLA, Raipur (C.G) by way of which the application under section 105 Crpc preferred by the petitioner is Rejected (ANNEXURE P-2). iii. Pleased to quash the order dated 12.03.2026 passed by the learned Special Court PMLA Raipur by way of which the Application under section 10 of the Fugitive of Economic Offender Act, 2018 by the respondent ED for declaration of the petitioner as fugitive. iv. Pleased to quash the summons issued by the Learned Special Court PMLA, Raipur dated 3 20.03.2026 (ANNEXURE P-28) for personal presence of the petitioner on 01.05.2026. v. Pass any further and other order(s) that this Hon'ble Court may deem fit and proper in the facts and circumstances of the instant case and in the interests of justice.” 2. At the outset, learned counsel appearing for the petitioner submits that he seeks permission of this Court to withdraw the present petition with liberty to institute a fresh petition, as the present proceedings suffer from a defect inasmuch as the order taking cognizance has not been specifically challenged, rendering the reliefs sought therein defective and incomplete. 3. Learned counsel appearing for the respective respondents fairly submits that they have no objection to the aforesaid prayer made on behalf of the petitioner. 4. In view of the aforesaid submissions and considering the nature of the defect pointed out, the present petition is dismissed as withdrawn. However, liberty is granted to the petitioner to file a fresh petition in accordance with law, subject to payment of costs quantified at Rs.20,000/- (Rupees Twenty Thousand only), to be deposited by the petitioner in the Registry of this Court for wasting the precious time of this Court by filing the present petition in such a casual and careless manner. The Registry shall thereafter transmit the said amount to the Government Special School for Visual Handicapped (Boys and Girls), Jashpur, Chhattisgarh. 4 5. It is further directed that certified copies of the documents annexed with the petition, if any, shall be returned to learned counsel for the petitioner after obtaining photocopies thereof for the record.
