Petitioner is before this Court seeking for the following reliefs: - 3 - HC-KAR NC: 2026:KHC:28894 WP No. 1753 of 2026 "WHEREFORE the Petitioners pray that this Hon'ble Court may be pleased to: I. Issue a Writ or Direction or Order to the Investigating officer, to direct the 3rd Respondent Bank to defreeze the bank account of the bearing Petitioner A/C No.159739400826, IFSC-INDB0001454, maintained with IndusInd Bank, AECS Layout, Kundalahalli. Bengaluru, Karnataka, and permit the Petitioner to use and operate his bank account. II. Grant such other and further orders as this Hon'ble Court deems fit and proper under facts and circumstances of the case in the interest of justice and equity". 2. The grievance of the petitioner is that the entire account of the petitioner maintained with respondent no.3 has been frozen and despite repeated requests, no information has been furnished as regards the reason for such freezing except to state that the freezing of the account has been made as per the instructions received on the NCRP portal. 3. Today, learned counsel for respondent no. 3 has filed a memo enclosing three orders received by the respondent/bank. - 4 - HC-KAR NC: 2026:KHC:28894 WP No. 1753 of 2026 4. A perusal of the memo along with the documents produced indicates that the complaints on 04/08/2023 is for a sum of Rs.5,000/-, on 06.11.2023 is for a sum of Rs.8618/- and on 01.11.2023 is for a sum of Rs.9358.09. Total amount being Rs.22976.09. Such being the case, the bank could have only frozen the account of the petitioner for a sum of Rs. 22,976.09 and not the entire account. 5. In that view of the matter, I pass the following: ORDER (i) Writ petition is partly allowed. (ii) The debit freeze of the account of the petitioner/lien on the account of the petitioner is restricted to a sum of Rs.22,976.09. (iii) Respondent no. 3 is directed to permit the petitioner to operate the bank account in respect of the balance amount. - 5 - HC-KAR NC: 2026:KHC:28894 WP No. 1753 of 2026 (iv) Needless to say, if any further orders are received by respondent no.3 for marking a lien or freezing the account, the bank would be free to act.
