Dubey, APP …...... 03 /19.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 103(1)/238/3(5) of the Bharatiya Nyaya Sanhita. 2. Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. The allegation is that this petitioner along with the wife of the deceased has committed murder of the deceased. Paragraph 31 of the case diary is the statement of Ataul Ansari who is the son of the deceased. He has seen the occurrence and had made a statement in the aforesaid paragraph that he has seen this petitioner with the help of the wife of the deceased (mother of the witness) committing murder. Further the fact that this Ataul Ansari has seen the murder is substantiated by the statement of Makbul Ansari at paragraph 15 and Bhola Ansari at paragraph 32 of the case diary. 5. Considering the direct allegation and evidence against this petitioner, I am not inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in 2026:JHHC:5291 2 connection with Poraiyahat PS Case No. 96 of 2025 corresponding to GR No. 1017 of 2025 (ST No. 387 of 2025), pending in the Court of learned Additional Sessions Judge-V, Godda stands rejected. 6.
