2. The petitioner is apprehending his arrest in connection with Simariya P.S. Case No.1 of 2026, for the alleged offences registered under Sections 69 and 3(5) of Bharatiya Nyaya Sanhita, 2023 and Sections 3 and 4 of Dowry Prohibition Act, 1961 pending in the Court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioner submits that the informant has earlier lodged a case against the petitioner being Chatra Sadar P.S. Case No.19 of 2024 in which the petitioner has been granted anticipatory bail by learned Sessions Judge in ABP No.211 of 2025 by
order dated 11.03.2025. He further submits that on the same allegation the present case has been lodged and the allegations are made of establishing relationship on the pretext of marriage and further allegations are made thereafter not marrying. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of establishing relationship.

Considering that earlier on the same allegation the case was lodged and anticipatory bail was granted to the petitioner in the said case by learned Sessions Judge and thereafter the present case has been lodged and in the present case it has been stated that for two years the informant has lived in New Delhi along with the petitioner and solemnizing the marriage in temple was also accepted in the present FIR. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.

Accordingly, the petitioner, above named, is hereby directed to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra in connection with Simariya P.S. Case No.1 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
