03/23.07.2026 Heard learned counsel appearing for the petitioners and learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Chirkunda P.S. Case No.63/2026, registered for the offence under Sections 126(2), 127(2), 115(2), 117(2), 132, 324(3), 324(4), 351(2), 352, 3(5) of the BNS, pending in the Court of the learned Chief Judicial Magistrate, Dhanbad.

Learned counsel appearing for the petitioners submits that the petitioners have been falsely implicated in the case and even petitioner no.1, who is a lady, she has also been made accused. He further submits that son of petitioner no.1 has been brutally assaulted by one Md. Afroz. He then submits that the allegations are made that for assaulting the said Md. Afroz, the police vehicle was stopped by the petitioners and hooliganism was made and they have damaged the vehicle of the police. He then submits that these allegations are false. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioners.

Learned counsel appearing for the State opposed the prayer and submits that there are serious allegations against the petitioners of altercation with the police and even damaging the vehicle of the police. She further submits that the petitioners have tried to assault the arrested person from the police vehicle. On these grounds, she submits that the prayer for anticipatory bail may kindly be rejected.

On perusal of the FIR, it transpires that there is direct allegation of stopping the police vehicle and damaging the same against petitioner nos. 2 and 3 and they have also tried to assault the arrested person and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to petitioner nos. 2 and 3, namely, Ajay Paswan and Om Prakash Paswan @ Eknath Om Prakash respectively and, as such, their prayer for anticipatory bail is, hereby, rejected.
6. So far as petitioner no.1 is concerned, she is a lady and it has been pointed out that her son has been brutally assaulted by Md. Afroz, who was arrested by the police and the allegations are made that the petitioners have tried to assault Md. Afroz from the police vehicle and in the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to petitioner no.1, namely, Sunita Devi.

Accordingly, petitioner no.1, namely, Sunita Devi is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, she shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,

Dhanbad in connection with Chirkunda P.S. Case No.63/2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
8. Consequently, this application is partly allowed and disposed of.
