This petition has been filed seeking direction to the respondents to pay incentive bonus to the petitioner which is payable under Clause 5.3 of the Percentage Rate Tender and Contract for Works (Annexure P/11). 2. Learned counsel for the petitioner would submit that the petitioner has already made representation (Annexure P/12) to respondent No.5 herein/Executive Engineer, Public Works Department, for payment of incentive bonus, but the same has not been considered and decided yet, therefore, respondent No.5 may be directed to decide the petitioner’s representation within the stipulated time. 3. Learned State counsel would submit that the petitioner’s representation will be considered and decided in accordance with law. 4. We have heard learned counsel for the parties, considered their submissions and gone through the records. 3 WPC No. 1241 of 2026 5. Admittedly, petitioner has already made representation (Annexure P/12) before respondent No.5 herein seeking incentive bonus. In that view of the matter, respondent No.5/Executive Engineer, Public Works Department is directed to consider and decide the petitioner’s representation with regard to incentive bonus in accordance with law within three months from the date of receipt of copy of this order. Petitioner is at liberty to file additional representation/additional documents in support of earlier representation which is pending before respondent No.5. 6. With the aforesaid observation/direction the instant writ petition stands disposed off. However it is made clear that this Court has not expressed any opinion on the merits of the case.
