This bail application has been filed on behalf of Raj Kumar Sah who is in custody since 20.08.2025 in connection with Dumka (Town) P.S. Case No. 117 of 2025 corresponding to G.R. Case No. 556 of 2025, for the offence registered under Section 69 of the BNS, 2023 pending in the Court of learned CJM, Dumka is pressed into motion. It is submitted by the learned senior counsel on behalf of petitioner that the prosecutrix is an adult, aged 30 years, and as per the F.I.R., consensual physical relationship continued for more than one year without any protest and demure on the part of the prosecutrix. It is further submitted that there is a delay in lodging the F.I.R. and there is no material to suggest that the said physical relationship was established on a false pretext of marriage. Learned A.P.P. for the State opposed the prayer for bail. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
