This is the first bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 712/2025 registered at Police Station - Civil Line Rampur, Korba District- Korba (C.G.), for the offences punishable under Sections 25, 27 of the Arms Act and Section 61 of BNS 2023. The prosecution story, in brief, is that on 13.11.2025 through an informer the Police of Police Station Civil Line Rampur, Korba District Korba, Chhattisgarh has received an information that one unknown person near Patharri Ganesh chowk who is wearing a black color shirt pant is having a possession of pistol gun which is tucked in her lower back, upon receiving such information the police officers has taken an immediate action and blockade the Applicant near Ganesh Chowk whereby upon searching a silver color pistol gun with 6 pieces of unused bullets were found and seized from the possession of the Applicant, thereafter, a notice under section 94 of Bharatiya Nagarik Suraksha Sanhita, 2023 was served to the Applicant to show legal documents relating to the said seizure but no such documents was produced by the Applicant hence the present FIR was lodged against the Applicant as FIR no. 712/2025 registered on dated 13.11.2025 at Police Station Civil Line Rampur, Korba District Korba, Chhattisgarh for alleged offence under sections Section 25, 27 of Arms Act and section 61 of Bharatiya Nyaya Sanhita, 2023. That, during the course of investigation, the Applicant in his memorandum has stated that he has stayed in Shreeram Door Metric Hotel and he has brought total 32 pieces of unused bullets and 2 magazine from Bihar out of which he has given 6 pieces of unused bullets and one magazine to the hotel owner Bablu Yadav therefore, the hotel owner Bablu Yadav has been later implicated as co-accused in the present case.

Learned counsel for the applicant submits that the applicant is an innocent person and has been falsely implicated in the present offence. It is further submitted that the trial is at the stage of completion, and the statement of the applicant under Section 313 has
3 been recorded. He further submits that the prosecution case is based on speculative and unsubstantiated allegations, as no seizure has been made from the applicant in connection with the alleged offence, and even the alleged recovery of ‘unused bullets’ and a pistol does not indicate any use, discharge, injury, threat, or commission of any offence. The applicant has no role in the alleged crime, and the allegations against him are vague, general in nature, and unsupported by any material on record, thereby adversely affecting his reputation. The co-accused has already been granted bail by the learned 3rd Additional Sessions Judge, Korba, vide order dated 19.11.2025, and on the principle of parity, the applicant is also entitled to be released on bail, as his role is neither distinct nor graver. The applicant is in judicial custody since 13.11.2025, and his continued detention along with hardened criminals may adversely affect his conduct and future. He is a young boy aged about 19 years with no criminal antecedents, having his entire life ahead of him, and prolonged incarceration would cause irreparable harm to his education, career, and prospects. The applicant is a permanent resident of Chakwa, Police Station Badhanaha, District Sitamarhi, Bihar, and there is no likelihood of his absconding. The trial is likely to take some time to conclude, and continued pre-trial detention would violate his fundamental right to life and personal liberty under Article 21 of the Constitution of India, as reiterated by the Hon’ble Supreme Court in Sanjay Chandra v. CBI, Hussainara Khatoon (III) v. Home Secretary, State of Bihar, and State of Kerala v. Raneef. Therefore, considering the settled principles of law and the facts of the case, the applicant deserves to be enlarged on bail. 4
4. On the other hand, learned State Counsel opposes the bail application of the present applicant and submits that the charge-sheet has already been filed in the present case. 5. I have heard learned counsel for the parties and perused the case diary. 6.
Considering the overall facts and circumstances of the case, the nature and gravity of the offence, and further taking into account that the trial has reached the stage of completion and the statement of the accused under Section 313 Cr.P.C. is scheduled to be recorded tomorrow, this Court is of the considered view that no ground is made out for grant of bail at this stage. Accordingly, the bail application stands rejected. 7. Accordingly, the bail application of the applicant – Rahul Kumar Singh, filed under Section 483 of the BNSS, involved in Crime No. 712/2025 registered at Police Station - Civil Line Rampur, Korba District- Korba (C.G.), for the offences punishable under Sections 25, 27 of the Arms Act and Section 61 of BNS 2023, is rejected. 8. Needless to say that the trial Court concerned is at liberty to proceed and conclude the trial expeditiously. 9. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information and compliance forthwith. Sd/-
