JUSTICE E.S.INDIRESH ORAL ORDER In this petition, petitioners are assailing the Endorsement dated 30.05.2025 (Annexure-E) passed by respondent No.3, inter alia sought for a direction to respondent No.3 to comply with the order of respondent No.2 in R.Misc.No.304/2024 dated 15.10.2024 (Annexure- D). 2. Having heard the learned counsel for the parties and perusing the impugned Endorsement dated 30.05.2025 (Annexure-E) would indicate that a request - 3 - HC-KAR NC: 2026:KHC:28598 WP No. 31210 of 2025 has been sought from the petitioners herein to provide 11E Sketch to effect katha. 3. Perusal of the writ petition would indicate that there is judgment and decree in FDP No.2/2012 on the file of the II Additional Civil Judge and JMFC., Mandya, as per Annexure-B as per the decree dated 17.03.2022. 4. In that view of the matter, following the declaration of law made by the Division Bench of this Court in the case of G.RAMACHAR AND ANOTHER vs. THE STATE OF KARNTAKA AND OTHERS, reported in AIR 2016 KAR 124, I am of the view that the respondents are restrained from insisting for 11E Sketch. 5. Therefore, I pass the following: ORDER i) The writ petition is allowed. ii) The Endorsement dated 30.05.2025 (Annexure-E) is hereby quashed. - 4 - HC-KAR NC: 2026:KHC:28598 WP No. 31210 of 2025 iii) The respondent - authorities are directed to consider the judgment and decree in FDP No.2/2012 dated 17.03.2022 (Annexure-B) and to demarcate the properties accordingly.
