The petitioner is apprehending his arrest in connection with Mango (Olidih) PS Case No.121 of 2026, for offence registered under section 308(3), 117(2), 109(1), 3(5) of BNS, 2023, pending in court of learned Judicial Magistrate, First Class, Jamshedpur. 3. Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case in a routine way and all the family members have been made accused. He next submits that grand-father of the petitioner has left for his heavenly abode in the year 2017, however, he has also been made accused in the FIR and to buttress his such argument, he refers to Annexure-2 which is the death certificate of the grand-father of the petitioner and he next submits that his cousin brother has been granted anticipatory bail in ABA No.3903 of 2026. He next submits that there is political rivalry between the uncle of the petitioner and the informant and in view of that altercation took place. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph no.16 of 2026:JHHC:21795 2 the petition and in view of that anticipatory bail may kindly be granted. 4. Learned State counsel opposes prayer and submits that allegations are there of assault and pursuant to that injury has been received and the injury is said to be grievous. 5. Annexure-2 suggest that grand-father of the petitioner has left for his heavenly abode in the year 2017, however, he has also been made accused in the FIR and it has been pointed out that due to political rivalry between the uncle of the petitioner and the informant the altercation took place and the co-accused person has been granted anticipatory bail as aforesaid and the allegations are made against the petitioner of assault only, and in the attending facts and circumstances of the present case, I am inclined to grant anticipatory bail to petitioner. 6. Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Judicial Magistrate, First Class, Jamshedpur, in connection with Mango (Olidih) PS Case No.121 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
