JUSTICE M.NAGAPRASANNA ORAL ORDER The petitioner – accused is before this Court calling in question proceedings in C.C.No.28/2026, pending before the Chief Judicial Magistrate, Bengaluru Rural, Bengaluru, for the offences punishable under Section 69 of the BNS, on the ground that the victim and the accused have got married and seek permission to compound the offence. 2. Learned counsel for the parties submit that the petitioner has married to the victim and the promise of marriage is fulfilled by the petitioner and are living happily. Therefore, they are before this Court seeking permission to compound the offences by producing a copy of the certificate of marriage and other relevant documents along with a memo. - 3 - HC-KAR NC: 2026:KHC:27706 CRL.P No. 3941 of 2026 3. The memo reads as follows: “The Petitioner respectfully submits that during the pendency of the above proceedings, the parties have amicably resolved all their disputes and differences and have solemnized their marriage on 22.02.2026, which has been duly registered before the Marriage Officer, Banasawadi, Bengaluru. Pursuant thereto, the parties are residing together as husband and wife and are leading a peaceful matrimonial life. It is further submitted that out of the said wedlock, the parties have been blessed with a female child born on 29.04.2026 at Vani Vilas Hospital, Bengaluru, and the newborn child was admitted to and subsequently discharged from the Special Newborn Care Unit (SNCU) of the said hospital. In support of the aforesaid facts, the Marriage Registration Certificate, Hospital Discharge Card and connected medical records are produced herewith for the kind perusal of this Hon'ble Court. Therefore, this Hon'ble Court may be pleased to take the said documents on record and pass appropriate orders in the interest of justice and equity.” In the light of the memo as afore-quoted and the fact that the parties to the lis has married each other on 22.02.2026, I deem it appropriate to obliterate the proceedings initiated against the petitioner. 4.
