The case set up by the petitioner is that under office order dated 31.8.2026 (Annexure P-6), he was promoted to the post of Assistant Research Officer and posted as such in District Statistical Office, Una; That petitioner is suffering from lung cancer and has recently been operated on that 1 Whether reporters of Local Papers may be allowed to see the judgment? yes - 2 - count in Indira Gandhi Medical College, Shimla [ a fact acknowledged in office order dated 18.02.2024 (Annexure P-4)]. Petitioner accordingly seeks his adjustment at a place convenient to him as set out in the writ petition where twelve posts are stated to be lying vacant. 3. In view of above, this writ petition is disposed of with liberty reserved to the petitioner to prefer a representation to respondent No.1/Competent Authority, seeking his adjustment. In case such a representation is so made within one week from today, the same shall be considered and decided in accordance with law and applicable transfer policy, keeping in view the facts of the case, within a period of two weeks thereafter. The decision so taken be also communicated to the petitioner. Till such time, office order dated 31.08.2026 (Annexure P-6) to the extent of petitioner’s posting at District Statistical Office Una, shall remain stayed. It goes without saying that in case the petitioner does not represent, the limited protection granted to him hereinabove shall cease to have force after one week. - 3 - Pending miscellaneous application(s), if any, also stand disposed of.
