JUSTICE E.S.INDIRESH ORAL ORDER In this petition, petitioners are seeking direction to the respondent-Authorities to act upon the order dated 18.08.2003 (Annexure-J) passed by the respondent No.2 and the representations made by the petitioners dated 03.09.2005, 28.10.2006, 15.12.2006, 03.10.2012, 12.08.2013, 27.12.2023, 09.02.2024 and 10.09.2025 produced at Annexures 'V' to 'V7' respectively for issuance of Saguvali Chit in favour of petitioners in respect of the schedule property. 2. Heard Sri. Bhat Ganapathi Narayan, learned counsel appearing for petitioners and Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents. 3. Sri. Bhat Ganapathi Narayan, learned counsel appearing for petitioners invited the attention of the Court to Official Memorandum dated 18.08.2003 (Annexure-J) issued by the respondent No.2-Deputy Commissioner and submitted that the respondent-Authorities are bound to take decision in the matter in the light of the aforesaid official memorandum and representations made by the petitioners produced at Annexures - 4 - HC-KAR NC: 2026:KHC:27575 WP NO.30807 OF 2025 'V' to 'V7'. Learned counsel appearing for petitioners also invited the attention of the Court to the Notice dated 05.09.2003 (Annexure-K), wherein the respondent No.4- Tahsildar informed the petitioners to obtain Saguvali chit in respect of the schedule property after making payment of necessary charges to Government. It is also submitted that the petitioners have paid the necessary charges to the Government as per Annexures 'N', 'P' and 'Q'. Accordingly, he sought for interference of this Court. 4. Per contra, Smt. B.P. Radha learned Additional Government Advocate submitted that the official memorandum referred to by the petitioners is of the year-2003 and therefore, the petition deserves to be dismissed. 5. In the light of submission made by learned counsel appearing for the parties, on careful consideration of Official Memorandum dated 18.08.2003 (Annexure-J) issued by the respondent No.2, it is forthcoming that the decision has been taken to grant the land in favour of petitioners and in furtherance of the same, respondent-Authorities have informed the petitioners to obtain Saguvali Chit in respect of the - 5 - HC-KAR NC: 2026:KHC:27575 WP NO.30807 OF 2025 schedule land, after making payment of necessary charges as per Notice dated 05.09.2003 (Annexures 'K', 'L' and 'M'). Thereafter, the petitioners have paid requisite amount to the competent authority as per Annexures 'N', 'P' and 'Q'. Therefore, I am of the considered opinion that the respondent No.2 shall consider the representations made by the petitioners for issuance of Saguvali Chit in respect of the schedule property. Accordingly, the respondent No.2-Deputy Commissioner is directed to consider the representations made by the petitioners dated 03.09.2005, 28.10.2006, 15.12.2006, 03.10.2012, 12.08.2013, 27.12.2023, 09.02.2024 and 10.09.2025 produced at Annexure-V series and take decision in the matter, within a period of two months from the date of receipt of this order.
