THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE RAVI V HOSMANI ORAL ORDER This petition is filed seeking following prayer. "To set-aside the order passed by the Hon'ble LII Additional City Civil and Sessions Judge (CCH-53) at Bangalore in Criminal Appeal No.2238/2018 dated 20.02.2019 and consequently extend the time for a period of 2 months to deposit the 10% of cheque amount before the Hon'bel trial Court XXV A.C.M.M. at Bangalore in the ends of justice." 2. Sri B.H. Shamanna, learned counsel for respondent vehemently submits that above petition was not only untenable but also not survive for consideration as order impugned was on an application filed under Section 148 (1) of Negotiable Instruments Act, 1881 ('NI Act') in an appeal filed against order of conviction and directing petitioner to deposit 10% of cheque amount and execution of personal bond for balance - 3 - HC-KAR NC: 2026:KHC:28592 CRL.P No. 6665 of 2019 amount on or before 14.12.2018 i.e., within one month. It was submitted, after rejection of second subsequent request for extension was rejected present petition was filed. In very prayer, petitioner had sought for extension of time by 2 months and which this Court had granted. Despite lapse of said period, long back petitioner continued default. Therefore, petition would not survive for consideration and sought dismissal. 3. Sri Sharvan S Lokre, learned counsel for petitioner does not dispute submission. 4. In view of above facts and circumstances, there would be no justification for continuation of above petition. Hence, petition is dismissed as having become infructuous.
