The petitioner has filed this petition seeking the following reliefs:- 10.1 direct, the respondents to consider the case of the petitioners for regularization to the post on which the petitioners are service since 2008 10.2 Any appropriate order/ direction may also be kindly passed by Hon'ble Court in favor of Petitioners, which deems to be fit in the circumstances of the case. 2. Learned counsel for the petitioners would submit that the petitioners were engaged by respondents No. 2 & 3 in 2008 as Cook, Peon and Water Man on daily wage basis, and they are still working. She would further submit that the Hon’ble Supreme Court in the matter of Narendra Kumar Tiwari and Others vs. The State of Jharkhand and Others, Civil Appeal Nos. 7423- 7429 of 2018 dealt with the issue of the regularization of daily- rated employees. She prays to allow this petition. 3 3. On the other hand, learned State counsel would oppose the submissions made by counsel for the petitioner. He would submit that since the petitioners are daily-rated employees engaged after 1997, they have no legal right to claim regularization according to the circular dated 5.3.2008. 4. I have heard learned counsel for the parties and perused the documents present on the record. 5. The Hon’ble Supreme Court in the matter of Narendra Kumar Tiwari (supra) held in para 11 as under:- “11. Under the circumstances, we are of the view that the Regularisation Rules must be given a pragmatic interpretation and the appellants, if they have completed 10 years of service on the date of promulgation of the Regularisation Rules, ought to be given the benefit of the service rendered by them. If they have completed 10 years of service they should be regularized unless there is some valid objection to their regularization like misconduct etc.” 6. Considering the fact that the petitioners have been working with respondents No. 2 & 3 since 2008 and are still in service, and the claim of the petitioner for regularization is covered by the judgment of the Hon’ble Supreme Court rendered in the matter of Narendra Kumar Tiwari (supra). Accordingly, respondents No. 2 & 3 are directed to consider the claim of the petitioners for 4 regularization in the light of the said judgment within a period of 90 days from the date of receipt of a copy of this order. 7.
