2026:HHC:37161 IN THE HIGH COURT OF HIMACHAL PRADESH AT SHIMLA CMP.M No. 1405 of 2026 & LPA No. 509 of 2026 Decided on : 31.08.2026 State of Himachal Pradesh and others …Appellants Versus Chet Ram …Respondent Coram The Hon’ble Mr. Justice G.S. Sandhawalia, Chief Justice. The Hon’ble Mr. Justice Chirag Bhanu Singh, Judge. Whether approved for reporting?1 For the appellants : Mr. Gobind Korla, Additional Advocate General. G.S. Sandhawalia, Chief Justice (Oral ) CMP. M No. 1405 of 2026 Keeping in view the averments made in the application, duly supported by an affidavit of the official, delay of 94 days in filing the appeal is condoned. 2. The application stands disposed of accordingly. LPA No. 509 of 2026 3. The appellants seek consideration of the judgment passed by the learned Single Judge, in Civil Writ Petition No. 2975 of 2025, titled Chet Ram Vs. State of Himachal Pradesh and others, dated 11.03.2026, wherein an innocuous direction had been issued that the arrears which may be due to the 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:37161 petitioner on account of the revised pay scale, as mentioned in Para 2 of the preliminary submissions of the written statement, be also released within 3 months, failing which, the amount would entail simple interest @ 6% per annum from the date of the judgment till its actual realization. 4. It is pertinent to notice that the petitioner had given up his prayer for counting his daily wage service with effect from 01.07.1990, since he had already been regularized with effect from 01.01.2001, vide order dated 29.07.2024 (Annexure R-VI), which was passed in pursuance of the earlier order in Civil Writ Petition No. 655 of 2013, decided by the Coordinate Bench, whereby regularization had been ordered within a period of three months. 5. As per the order of regularization dated 29.07.2024 (Annexure R-VI), he was entitled for consequential benefits which included financial benefits of arrears as admissible due drawn difference of pay from due date. 6. In the written statement also, as noticed by the learned Single Judge, the only issue was that out of an amount of Rs. 2,73,589/-, which was the arrears from 01.01.2016 to 31.12.2021, Rs. 80,000/- had already been paid in two installments, however, Rs.1,93,589/- was still pending to be paid as per the direction of the Government. 3 2026:HHC:37161 7. In such circumstances, the State had admitted that the balance amount is still pending. We do not find any plausible reason as such, as to why the State had filed the present appeal. Nothing had been shown that why the appellant had not been paid and neither any notification had been placed on record, though an attempt has been made to argue that similar matters were pending consideration before the Division Bench, whereby staggered payments as such, were being done by the State for the revised pay scale. 8. Having not taken any such defence in the written statement, we are of the considered opinion that it is an innocuous order, as the State itself had admitted that the amount is due and payable and the learned Single Judge had simply directed the payment to be made within a time bound manner. Resultantly, there is no merit in the present appeal and no question of law arises for consideration by this Court. 9. At this stage, learned Advocate General undertakes that the amount will be paid within a period of one month from today, so that the penal interest clause might not come into force. 10. Keeping in view of the defence taken and the peculiar circumstances, the undertaking of the learned Advocate General is taken on record to the effect that if payment is not made within a period of one month from today, the order of the 4 2026:HHC:37161 learned Single will remain in force. 11. Accordingly, the present appeal is dismissed. Pending miscellaneous application(s), if any, also stands disposed of accordingly. (G.S. Sandhawalia) Chief Justice (Chirag Bhanu Singh) Judge August 31, 2026 (Shivank Thakur)
