JUSTICE P SREE SUDHA ORAL ORDER Though this matter has come up for admission, with consent of learned counsel, the same is taken up for final hearing and disposed of by this order. 2. Heard learned counsel for petitioner and learned counsel for respondent. 3. This petition is filed by wife for transfer of M.C.No.306/2025 filed by husband for divorce before Principal Family Court at Bangalore to the Family Court, Bellary. 4. The Petitioner is residing with her aged mother and also two minor children at Bellary and thus she requested for transfer of the same to the Family Court at Bellary. The distance between Bellary and Bangalore is 308 kms. Petitioner stated that her marriage with respondent was performed in the year 2013 and they are blessed with two children. Presently they are studying in 7th and 1st standard, respectively in Bellary school. It is stated that petitioner and respondent were BE and - 3 - HC-KAR NC: 2026:KHC:29144 CP No. 34 of 2026 MBA graduates. Both of them were working in HP company and presently she is not working and earning. She stated that her mother aged 75 years is depending on her and her husband filed G&WC No.191/2025 for custody of the children, but it was transferred to Bellary Court and re-numbered as G &WC No.16/2025 in Bellary Family Court. The petitioner also filed Crl.Misc.No.238/2025, before the same family court for maintenance. Further, stated that so far respondent has not paid any maintenance to the children. 5. Learned counsel for respondent stated that respondent is working as a Manager in a Private Company in Bangalore and he is residing with his aged parents and he has to attend the courts at Bellary for Guardian and Wards Act matter and also for maintenance cases on different dates. Thus he requested to post all the matters on one date so that it will be convenient for him to attend. Therefore this court finds that it is inconvenient for the petitioner to travel with children all the way to Bangalore. Therefore, MC No.306/2025 filed for divorce by her husband is to be transferred to Family Court at Bellary. As all the matters are before same court, this Court finds that it - 4 - HC-KAR NC: 2026:KHC:29144 CP No. 34 of 2026 is just and reasonable to direct the Family Court, Bellary to post all the matters on one day for the convenience of the parties. Family Court is also directed not to insist upon the presence of the respondent unless there is any requirement by the court. He can file his chief affidavits and he can be cross examined either through Commissioner or video conferencing. With this observation, this CP is allowed.
