The plaintiff filed the suit against the respondent for permanent injunction in respect of the land to an extent of Ac.1.22 cents in T.S. No. 189A in Hindupur village. Along with the suit, I.A. No. 264 of 2025 was filed under Order XXXIX, Rules 1 and 2 C.P.C. seeking temporary injunction restraining the respondent and his followers from interfering with the peaceful possession of the petitioner over the suit schedule property. However, on 31.07.2025, the trial Court adjourned the case to 01.08.2025 for orders and on 01.08.2025, the trial Court directed issue of urgent notice to the respondent. Thereafter, there is no progress in the hearing of the petition. Hence, the petitioner is aggrieved by non-disposal of the interlocutory petition. 3 Since the purpose of approaching the Court and filing the interlocutory application with the suit would be defeated unless an expeditious hearing is given and the petition is disposed of on merits, the revision petition is disposed of directing the trial Court to dispose of I.A. No. 264 of 2025 in O.S. No. 266 of 2025 on the file of the Court of Civil Judge (Junior Division), Hindupur on merits within a period of one (1) month from the date of receipt of the copy of this order, after providing one last opportunity to the respondent to file counter, if not filed so far.
