Petitioner, Satish Kumar and others have invoked the contempt jurisdiction of this Court against non-compliance of the judgment dated 29.07.2025 [Annexure C-1, Colly] passed by Co-ordinate Bench of this Court in CWP No.12257 of 2025, titled Satish Kumar & Others v. State of Himachal Pradesh and Ors., directing to consider and decide the representation(s) filed by the petitioners [Annexure P-4 in the said writ petition] in the light of judgment passed in Surya Prabha’s case, within

Heard. 3. Notice. Mr. Varun Chandel, Learned Additional Advocate General, accepts and waives service of notice on behalf of the respondents. 4. Upon listing of the matter today, Learned State Counsel has furnished Instructions dated 01.09.2026 [Taken on Record] received from the Director of School Education, Himachal Pradesh enclosing a copy of Office Order issued by Deputy Director of School Education (Elementary) Kangra at Dharamshala, fixing the pay of the petitioners on promotion from JBT to the post of Head Teachers under Fundamental Rules 22 (1) (a) (1). 5. In response, Learned Counsel for the petitioners submits that though the pay fixation orders have been issued on 01.09.2026 but the
2026:HHC:37351 - 3 - admissible benefits have not been released as yet. 6. In aforesaid backdrop and with the consent of Learned Counsel(s) instant petition is closed with a direction to the Respondents-Competent Authority to implement the judgment dated 29.07.2025 [Annexure C-1, Colly] by releasing the admissible benefits, if any, within a period of six weeks from today. 7.
Needless to say, that liberty is reserved to the petitioners for seeking appropriate remedy, in case, the grievance still survives hereinafter, in accordance with law. (Ranjan Sharma)
