Petitioner has filed this writ petition seeking following reliefs. “10.1 This Hon'ble Court may kindly be pleased to direct the respondent authorities to consider and decide the pending representation / appeal, filed by the petitioner before the respondent authorities, for payment of salary for the period petitioner was illegally kept under suspension & for restoration of four salary increments, which was withheld with cumulative effect, by merging it with revised pension, within stipulated time frame. 10.2 This Hon'ble Court may kindly be pleased to Direct the respondents to Treat the entire suspension period as period spent on duty for PAWAN KUMAR JHA Digitally signed by PAWAN KUMAR JHA 2 / 2 all purposes, Release full salary for the suspension period with arrears & Restore all withheld increments with cumulative effect. 10.3 This Hon'ble Court may kindly be pleased to grant interest on the delayed payment of salary and increments. 10.4 This Hon'ble Court may kindly be pleased to call for entire records from the office of the respondents in respect of petitioner's claim for kind perusal of this Hon'ble High Court. 10.5 That, any other writ, order, directions or relief which this Hon'ble Court may deem fit may kindly be passed in favour of the petitioner.” 2. At the outset, learned counsel for petitioner submits that petitioner has already submitted representation for treating suspension period to be service period which till date is pending consideration and therefore direction be issued to Respondent No. 4 to consider and take decision on the representation of petitioner at the earliest within specific time frame. 3. Learned State counsel submits that in view of limited prayer made by learned counsel for petitioner, he is having no objection. 4. On due consideration of the submission of learned counsel for the parties, without observing anything on merits of case, this writ petition at this stage is disposed of directing Respondent No. 4 to consider and take decision on the representation dated 01.09.2023, submitted by petitioner, in accordance with law, expeditiously, preferably within a further period of 02 months from the date of receipt of copy of order passed by this Court. 5.
