JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.1 in SC No.123/2026 pending before the Court of LXI Additional City Civil and Sessions Judge, Bengaluru arising out of Crime No.180/2023 registered by Vidyaranyapura Police Station, Bengaluru City for the offences punishable under Sections 399 and 402 of IPC is before this Court in this petition filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. - 3 - HC-KAR NC: 2026:KHC:28667 CRL.P No. 5286 of 2026 3. Perusal of the material on record would go to show that on the merits of the case, the petitioner, who is arrayed as accused No.1 in the case, was arrested on 23.07.2023 and was granted regular bail by the jurisdictional Sessions Court in Crl.Misc.No.7109/2023 by order dated 10.08.2023. Subsequently, the case was committed to the Court of jurisdictional Sessions Judge. Since the petitioner failed to appear before the trial Court on the regular dates of hearing, coercive steps were taken against him and his presence was secured and he was remanded to judicial custody. Thereafter, the bail petition filed by the petitioner in S.C.No.123/2026 was dismissed by the trial Court on 05.03.2026. It is under these circumstances, he is before this Court. 4. Learned counsel for the petitioner submits that out of the five criminal cases registered against the petitioner, he has been acquitted in three cases. He further submits that the petitioner has not involved - 4 - HC-KAR NC: 2026:KHC:28667 CRL.P No. 5286 of 2026 himself in any criminal case after he was released on bail in the present case in Crl.Misc.No.7109/2023. 5. Be that as it may, the fact remains that on the merits of the case, the petitioner was granted bail by the jurisdictional Sessions Court as stated above. It is only on account of his failure to appear before the Trial Court on the regular dates of hearing, he was arrested and remanded to judicial custody. For the mistake committed by the petitioner, he has been sufficiently punished. Further, the petitioner has undertaken to co-operate with the trial Court for early disposal of the case. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively subject to appropriate conditions. 6. Accordingly, the following: ORDER The Criminal Petition is allowed. - 5 - HC-KAR NC: 2026:KHC:28667 CRL.P No. 5286 of 2026 The petitioner is directed to be enlarged on bail in S.C.No.123/2026 pending before the Court of LXI Additional City Civil and Sessions Judge, Bengaluru arising out of the Crime No.180/2023 registered by the Vidyaranyapura Police Station, Bengaluru City for the offences punishable under Sections 399 and 402 of IPC, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:28667 CRL.P No. 5286 of 2026 e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off. f) The petitioner shall appear before the Station House Officer of Vidyaranyapura Police Station, Bengaluru City on every 2nd Sunday of every month and mark his attendance between 10.00 a.m. and 1.00 p.m. for a period of one year from the date of his release.
