This first anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the applicant, who is apprehending his arrest in connection with Crime No.32/2025 registered at Police Station AKHILESH KUMAR DEWANGAN Digitally signed by AKHILESH KUMAR DEWANGAN
2 Sakti District Sakti (C.G.) for the offence punishable under Section 420, 34 of the IPC. 2. Prosecution case in brief is that the complainant, Yogesh Kumar Dewangan, lodged a report on 25.01.2025 alleging that he had been operating a matrimonial website named “Devangan Rishta Matrimony” since July 2018. It was alleged that the operators of another matrimonial website, “Vivah Parichay Dot Com”, namely Kanhaiya Dewangan and Rama Dewangan, dishonestly obtained and copied the bio data and profiles of prospective brides and grooms registered on the complainant’s website and unlawfully uploaded and used the same on their own website. During investigation, it was revealed that the person referred to as Rama Dewangan in the FIR was, in fact, Rama Korsewada, the present applicant/accused. The investigation further disclosed that certain registered users had shared their login credentials with the accused persons, who allegedly used the same to gain access to the complainant’s website and copy the profiles of registered members. During the course of investigation, the applicant was found absconding from her known address, a memorandum to that effect was prepared, and a charge-sheet was filed against the other accused persons while showing the applicant as absconding. The prosecution alleges that the applicant, in concert with the co-accused, was involved in acts constituting cheating and related offences. Hence, the bail application. 3
3. Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in the present case. He further submits that two of the co-accused persons, namely, Seema Devangan and Deepak Devangan have been granted anticipatory bail by the 1st Additional Sessions Court, Sakti vide orders dated 18.02.2026, copies of the same is annexed as Annexure A-2 and A-3. He also submits that main accused, Kanhaiyalal Devangan has been granted regular bail by this Court vide order dated 28.04.2026 passed in MCRC No.2807 of 2026, hence he prays for grant of anticipatory bail to the applicant. 4.
On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail and submits that the allegation against the applicant is that she, along with the co-accused, dishonestly gained access to the complainant's matrimonial website and unlawfully copied the bio data and profiles of registered users for use on another matrimonial website, thereby committing cheating and related offences. It is further alleged that during the investigation she remained absconding and could not be traced at her known address. Therefore, the applicant is not entitled for grant of bail. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, submissions of

4 available in case diary, and the fact that though the applicant allegedly in connivance with the co-accused persons, unlawfully accessed the complainant's matrimonial website and dishonestly copied the bio data and profiles of registered users for uploading and use on another matrimonial website, thereby causing wrongful loss to the complainant and committing offences relating to cheating, but considering the fact that two of the co-accused persons, namely, Seema Devangan and Deepak Devangan have been granted anticipatory bail by the 1st Additional Sessions Court, Sakti vide orders dated 18.02.2026 and one co-accused, Kanhaiyalal Devangan has been granted regular bail by this Court vide order dated 28.04.2026 passed in MCRC No.2807 of 2026, also considering the fact that present applicant is a lady, as such, without further commenting anything on merits, this Court find it appropriate to grant anticipatory bail to the applicant.

Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicant - Rama Korsewada, on executing a personal bond with one surety in the like sum to the satisfaction of the arresting Officer, he shall be released on bail on the following conditions:- (a) She shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such fact to the Court. (b) She shall not act in any manner which will be prejudicial to fair and expeditious trial.
5 (c) She shall appear before the trial Court on each and every date given to her by the said Court till disposal of the trial. (d) The applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court. (e) She shall not involve herself in any offence of similar nature in future.
