By this application, the petitioner has prayed for bail in connection with Mukalmua P.S. Case No. 14/2026 registered under Section 22(b)/27 of the NDPS Page No.# 2/3 Act. The ejahar dated 06.02.2026 reveals that on a secret information that some persons are travelling from Hajo to Mukalmua with a pulsar vehicle for the purpose of selling NDPS substance, the police personnel proceeded to the said location and on noticing three persons on a pulsar bike, stopped them and on search being made on all the three persons, three strips of Hydrocloride and acetaminophene capsules have been recovered along with 100ml bottle of cough syrup. The police have also seized the motor cycle as well as the mobile phone. Mr. S.M. Mollah, learned Counsel for the petitioner submits that the petitioner disclosed before the police personnel that he bought that one strip containing 10 tablets from one Mustafizur Rahman and that the same were bought only for personal consumption as he is an addict. The learned counsel further submits that the petitioner has been inside the jail for 32 days and that since he is an addict and he does not deal in the business of drugs, bail is prayed for. Mr. M.P. Goswami, learned Additional Public Prosecutor for the State submits that it is not clear as to what number of tablets were recovered from the petitioner as the FIR and the forwarding report shows that three strips were recovered from the three persons, who was arrested from the spot. He also submits that the drugs recovered from Mustafizur Rahman later also shows that the petitioner is involved in dealing with the drug business. On consideration of the submissions and more so in view of the fact only one strip was recovered from the petitioner, who stated to be an addict under Section 27 of the NDPS Act, this Court finds it fit to enlarge the petitioner on bail on furnishing of a bail bond of Rs. 20,000/- with one local surety of like Page No.# 3/3 amount to the satisfaction of Special Judge, Nalbari under the following conditions: i) The petitioner will appear before the Trial Court as and when call for. ii) The petitioner will not influence the witnesses connected with the case.
