The petitioner is apprehending her arrest in connection with Giddi P.S. Case No. 63 of 2024, registered for the offence under Sections 303(2), 317(2) and 3(5) of Bhartiya Nyaya Sanhita, 2023, Section 30(ii) of Coal Mines Act and Section 33 of the Indian Forest Act, pending in the court of learned Judicial Magistrate, 1st Class, Hazaribag. 3. Learned counsel appearing for the petitioner submits that the petitioner happens to be owner of two Hyva trucks and the allegations are made of carrying coal. He next submits that the petitioner is having no criminal antecedent as disclosed in para 14 of the petition. According to him, although challans were there and in spite of that the FIR has been registered. 4. Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of illegally carrying the coal. 5. In the FIR, tax invoices and e-way bill are annexed however, that is in dispute and that is the subject matter of investigation and trial and the petitioner is said to be the owner of Hyva trucks and having no criminal antecedent as disclosed in para 14 of the petition, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner. 6. Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of 2026:JHHC:21914 his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Hazaribag, in connection with Giddi P.S.
