INDIRESH - 3 - HC-KAR NC: 2026:KHC:27572 WP NO.19561 OF 2023 ORAL ORDER In this petition, the petitioner is challenging the order dated 30th May, 2023 (Annexure-A) passed by the respondent No.2-Deputy Commissioner in R.P. No.280/2021. 2. Heard Sri. M.J. Alva, learned counsel on behalf of Sri. Venkatarami Reddy, appearing for the petitioner and Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4. 3. Sri. M.J. Alva, learned counsel appearing for the petitioner invited the attention of the Court to order dated 07th April, 2021 (Annexure-E) passed by the respondent No.3- Assistant Commissioner in R.A.(A)No.393/2017-18 and contended that the appeal before the respondent No.3 is allowed and the order in M.R. No.12/2009-10 in respect of the subject land came to be set-aside by directing the respondent No.4-Tahsildar to enter the name of the respondent No.7- Gowramma in the revenue records. Learned counsel further submits that, in pursuance of the order dated 07th April, 2021 (Annexure-E) passed by the respondent No.3 in R.A.(A)No.393/2017-18, the respondent No.7-Gowramma sold the subject land in favour of the petitioner under registered - 4 - HC-KAR NC: 2026:KHC:27572 WP NO.19561 OF 2023 Sale Deed dated 09th August, 2021 (Annexure-H). Accordingly, learned counsel appearing for the petitioner contended that the respondent No.2-Deputy Commissioner has not considered the entire material on record while passing the impugned order. Hence, he sought for interference of this Court. 4. Per contra, Smt. B.P. Radha, learned Additional Government Advocate appearing for respondents 1 to 4 sought to justify the impugned order passed by the respondent No.2. 5. In the light of submission made by learned counsel appearing for the parties, on perusal of the registered Sale Deed dated 09th August, 2021 (Annexure-H), the same would indicate that the respondent No.7-Gowramma sold the subject land in favour to the petitioner. It is also forthcoming that the respondent No.7-Gowramma filed R.A (A).No.393/2017-18 before the respondent No.3-Assistant Commissioner, which came to be allowed by order dated 07th April, 2021 (Annexure- E) and also direction was issued to the respondent No.4- Tahsildar to enter the name of the respondent No.7-Gowramma in the revenue records in respect of the subject land. In that view of the matter, I find force in the submission made by learned counsel appearing for the petitioner that the - 5 - HC-KAR NC: 2026:KHC:27572 WP NO.19561 OF 2023 respondent No.2-Deputy Commissioner, without application of mind and not considering the entire material on record, has passed the impugned order dated 30th May, 2023 (Annexure-A) in R.P. No.280/2021 subsequent to execution of the Sale Deed dated 09th August, 2021 in favour of the petitioner. Therefore, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 30th May, 2023 (Annexure-A) passed by the respondent No.2-Deputy Commissioner in R.P. No.280/2021 is hereby set-aside and order dated 07th April, 2021 (Annexure-E) passed by the respondent No.3- Assistant Commissioner is confirmed; (iii) The respondent No.4-Tahsildar is directed to enter the name of the petitioner in revenue records in respect of the subject land in terms of the registered Sale Deed dated 09th August, 2021 (Annexure-H) within a period of two months from the date of receipt of this order.
